RoadConscious — Terms of Service

These Terms are a contract between you and Infinityx Digital LTD ("we", "us", "RoadConscious") governing your use of the RoadConscious app and website (the "Service"). By installing or using the Service you accept these Terms. If you don't accept them, don't use the Service.
1. What RoadConscious is — and is not
RoadConscious is a driver-assistance tool that gives audio warnings intended to alert you before you drive into certain time-restricted roads in London (such as bus lanes, School Streets and Low Traffic Neighbourhood filters), so you can choose to avoid them.
It is an aid, not a substitute for your own attention. Road signs and markings, and the law, are always the authority. RoadConscious does not control your vehicle, does not guarantee it will detect every restriction, and does not replace your duty to observe the road and drive lawfully and safely.
2. No guarantee of accuracy or completeness
We compile restriction data from public sources (council Traffic Regulation Orders, Transport for London open data, and similar) and take reasonable care to keep it accurate. However, we do not warrant that the data or the warnings are complete, accurate, current, or that the app will detect or warn about any particular restriction. Restrictions change, GPS can be inaccurate (especially indoors or among tall buildings), and data can be missing or wrong.
You remain solely responsible for obeying all road signs, markings and traffic laws, whether or not RoadConscious warns you.
3. Safe use while driving
You must use the Service hands-free and lawfully: mount your device, do not hold or interact with your phone while driving, and follow the rules on mobile-device use while driving. RoadConscious is audio-first for this reason. Never let the app distract you. You are responsible for your own safe driving at all times, and for deciding whether it is safe to act on any warning.
4. Eligibility & accounts
You must be at least 18 and hold a valid driving licence to use RoadConscious for driving. If you create an account, you're responsible for keeping your login secure and for activity under it. Sign-in is via Google; you're responsible for your Google account.
5. Subscriptions, trials and payments
Full features beyond a trial period requires a paid subscription (currently £2.99/month), with a 30-day free trial where offered. Payments are handled by Stripe; we don't store your card details.
Subscriptions auto-renew each period until cancelled. You can cancel any time via app (Manage Subscription); cancellation takes effect at the end of the current paid period, and you keep access until then.
Refunds & cancellation rights: you may have a statutory right to cancel within 14 days of subscribing (Consumer Contracts Regulations 2013). By starting a paid digital service during that period you may be asked to agree that performance begins immediately, which can reduce that right. Outside statutory rights, subscription fees are non-refundable except where required by law.
Prices may change; we'll give reasonable notice before a change affects you.
6. Field reports and reward credits
If you submit a field report (flagging or confirming a restriction, optionally with a note or voice note), you grant us a non-exclusive, royalty-free licence to use it to improve the Service. Reports may be reviewed, edited, rejected or removed at our discretion.
Any reward credit we may give for a valid report is non-cash, non-transferable, non-withdrawable store credit redeemable only against your RoadConscious subscription; it has no monetary value, may expire, and we may withhold, reverse or void it (including for suspected abuse or gaming). We may change or end the reward scheme at any time.
7. Acceptable use
You agree not to: use the Service in a way that is unsafe or unlawful; interfere with or attempt to break the Service; scrape, copy, resell or redistribute our data or app; submit false reports; or use the Service to help anyone break the law. We may suspend or terminate accounts that breach these Terms.
8. Our liability
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or for your non-excludable statutory rights (including that a service will be provided with reasonable care and skill under the Consumer Rights Act 2015).
Subject to that, and to the fullest extent permitted by law:
We are not liable for any Penalty Charge Notice, fine, penalty, towing, clamping or other enforcement cost you incur, whether or not RoadConscious warned you — obeying the road remains your responsibility.
We are not liable for indirect or consequential loss, loss of profit, or loss arising from your reliance on a warning (or the absence of one), inaccurate data, GPS error, or the Service being unavailable.
Where we are liable to you, our total liability in any 12-month period is limited to the greater of <the amount you paid us in that period> or <£50>.
The Service is provided "as is" and "as available"; we don't guarantee it will be uninterrupted or error-free.
9. Data & privacy
Our use of your personal data (including location) is described in our Privacy Policy at https://infinityxd.uk/roadconscious-privacy-policy which forms part of these Terms.
10. Intellectual property
The app, its software, branding, and our compiled restriction dataset are owned by us or our licensors and protected by law. We grant you a personal, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, modify, reverse-engineer, or extract our dataset except as allowed by law.
11. Changes, suspension and termination
We may update the Service or these Terms; we'll post the new version with an updated date and, for significant changes, notify you in the app. Continued use means you accept the changes. We may suspend or withdraw the Service, or terminate your access, including for breach of these Terms. You can stop using the Service and delete your account at any time.
12. Governing law
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any mandatory consumer-protection rights you have where you live.
